Occupational asthma
Asthma can be caused or made worse by work. Symptoms of asthma include wheezing, coughing and tightness of the chest. Less well know symptoms include symptoms of rhinitis (sneezing/runny nose) and conjunctivitis.
Over 300 substances are known or suspected to cause occupational asthma. The main causes are isocyanates (used in paints and other ‘2 part’ or ‘2 pack’ substances), flour dust, some forms of metallic compounds (eg chromium, nickel) and epoxy resins.

Case Study:
Brooksbank and others v Noel Village Steel Founders
This was perhaps the biggest group occupational asthma claim relating to chromium exposure. The alleged exposure resulted from foundry operations involving stainless steel. Ian Glendenning’s approach to his evidence was praised by the Court.
The case involved consideration of exposures to risks to respiratory health in the foundry environment including ferrous foundry particulate, nickel, chromium and isocyanates. Case Study:
Protheroe & others v Boyne Smelters
This was a group action for ‘pot room’ asthma in a group of aluminium smelters’ working at the ‘Boyne Smelter’ facility in Queensland, Australia. Mr Glendenning’s report was based on an inspection visit at the facility and detailed analysis of extensive disclosure. The report was used by the parties in settlement negotiations and mediations. The actions were resolved before reaching Court. Mr Glendenning subsequently advised solicitors dealing with similar claims in New Zealand.
